Welcome to SeriousWokers, a freelance marketplace designed to connect freelancers with clients. By accessing or using our platform, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

By registering an account or using any of our services, you accept and agree to be bound by these Terms and Conditions, as well as our Privacy Policy. If you do not agree to these terms, please do not use our services.

2. Definitions

• “Platform” refers to SeriousWokers, including the website, mobile applications, and related services.
• “User” refers to any individual who uses the Platform, including Freelancers (sellers of services) and Clients (buyers of services).
• “Service” refers to any task, job, or project offered by a Freelancer and purchased by a Client through the Platform.

3. Account Registration

• Eligibility: You must be at least 18 years old and capable of forming a binding contract to register an account.
• Information: You agree to provide accurate, current, and complete information during the registration process and update such information to keep it accurate and current.
• Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• Verification: To complete the verification process, you must provide a valid national ID. This is necessary to ensure the security and integrity of the Platform.

4. User Responsibilities

• Compliance: Users must comply with all applicable laws and regulations when using the Platform.
• Prohibited Conduct: Users are prohibited from engaging in any activity that is fraudulent, abusive, or otherwise harmful to the Platform or other Users.

5. Service Listings

• Accuracy: Freelancers must provide accurate and detailed descriptions of the services they offer.
• Prohibited Services: The Platform prohibits services that are illegal, unsafe, or violate any of our policies.

6. Payments

• Fees: Clients agree to pay the fees associated with the services they purchase. SeriousWokers charges a commission fee on each transaction.
• Payment Methods: Payments are processed through our third-party payment processors. You agree to comply with the terms and conditions of these payment processors.
• Payouts: Freelancers will receive payouts for completed services through the Platform. To withdraw funds, users must have completed the verification process by providing a valid national ID. This is necessary to prevent fraud on the Platform. The timing and method of payouts are subject to the policies of our payment processors.

7. Subscriptions

• Subscription Plans: SeriousWokers may offer subscription plans that provide enhanced features or services for a recurring fee. Details of subscription plans, including pricing and benefits, will be clearly outlined on the Platform.
• Billing and Renewal: Subscription fees will be billed in advance on a recurring basis (e.g., monthly or annually) as per the selected plan. Subscriptions will automatically renew unless cancelled prior to the renewal date.
• Cancellations and Refunds: Users may cancel their subscriptions at any time. Cancellations will take effect at the end of the current billing cycle. Refunds for subscriptions are subject to our refund policy, which will be outlined on the Platform.

8. Dispute Resolution

• Disputes Between Users: SeriousWokers encourages Users to resolve disputes directly. If a resolution cannot be reached, Users can submit a dispute to the Platform for mediation.
• Platform Discretion: SeriousWokers reserves the right to make a final decision on any dispute.

9. Privacy

• Data Collection: We collect personal information from Users to provide and improve our services. This includes information provided during registration, profile creation, and service transactions.
• Data Usage: Personal information is used to facilitate transactions, provide customer support, and communicate with Users about their accounts and our services.
• Data Sharing: We do not share personal information with third parties except as necessary to provide our services (e.g., payment processors) or as required by law.
• Security: We implement industry-standard security measures to protect personal information from unauthorized access, use, or disclosure.

10. Intellectual Property

• User Content: Users retain ownership of the content they create but grant SeriousWokers a license to use, display, and distribute such content on the Platform.

11. Limitation of Liability

• No Warranty: The Platform is provided “as is” and “as available,” without any warranties of any kind. SeriousWokers does not guarantee the accuracy, completeness, or reliability of any content or services provided.
• Liability: SeriousWokers will not be liable for any damages arising from the use of the Platform, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

12. Indemnification

Users agree to indemnify and hold harmless SeriousWokers, its affiliates, and its respective officers, directors, employees, and agents from any claims, liabilities, damages, and expenses arising out of their use of the Platform.

13. Termination

• By User: Users may terminate their account at any time by following the instructions on the Platform.
• By SeriousWokers: SeriousWokers may terminate or suspend a User’s account at any time for any reason, including but not limited to violations of these Terms and Conditions.

14. Modifications

SeriousWokers reserves the right to modify these Terms and Conditions at any time. Users will be notified of any significant changes. Continued use of the Platform after such changes will constitute acceptance of the new terms.

15. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Uganda. Any disputes arising under or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Uganda.
